CONSUMER PRODUCT SAFETY IMPROVEMENT ACT (CPSIA) of 2008:
The Consumer Product Safety Improvement Act (CPSIA) of 2008 was signed in 2008 and goes into effect February 10, 2009. The CPSIA limits the concentration of lead and other heavy metals, as well as phthalates in children's products/childcare articles on which printing inks are used.
Since the initial release of the CPSIA guidelines there is a clarification on the regulations and how they impact the book printing industry. The CPSIA lead limit of section 101 does not apply to ordinary books intended for readers of all ages, including children. This covers books that are not intended or designed primarily for children. These books do not need a general conformity certification for lead content and do not require third-party testing of any kind.
This law states that children’s products manufactured before the law went into effect are not required to be tested for compliance before they are sold as long as the manufacturer has a “Level of Confidence” that these products do not exceed CPSIA lead limits. Victor Graphics, Inc. is currently establishing this “Level of Confidence” with the assistance of PIM and third party laboratories.
The General Conformity requirement relative to Third Party Testing of products in inventory will become a requirement in August of 2009. The "Reasonable Testing Program" allows printers to rely upon information from component testing (i.e., MSDS Sheets regarding lead content of inks, paper, coatings, etc) for the General Conformity Certificate.
